Denise Lash Interviewed in the Toronto Sun

Toronto Sun pic Consiglio.jpgDenise Lash was interviewed for an article in the Toronto Sun which discusses two cases in which  condo owners and residents faced legal trouble after avoiding complaints from their condominium boards.

In "Condo Battles can be Costly" Denise advises owners to not only comply with the rules and regulations for the building they reside in, but to also respond to compliance letters on a timely basis. She also warns owners that if the a case goes to court and a decision is made in the condominium corporation's favour, that,  just like in the two instances discussed in the article, most likely the owner will have to pay legal fees incurred by the corporation.

In the case of pet owners who have faced complaints about their pets as nuisances, Denise says that in order to avoid potential conflicts with their condo board and/or residents of the building, owners should be reviewing the condominium documentation before they purchase.

It is very unfortunate that Buyers rarely discuss the Rules and Regulations when they move in to a condominium unit; Many believe that rules are suggestions that can be twisted and bent to their own use. A vehicle in a single parking spot is permitted Two are not now matter how small or smart. BBQing on your Balcony, Satellite dishes, No NO.

But the condos also have an obligation to enforce the rules equitably.

The governing documents define the culture of the community. Most of the owners in our association have never read the documents and then are surprised and angry when they receive a notice from management. Being a board member can be very uncomfortable at times, these people are my neighbors. We all agreed to comply with the same rules. I am really tired of the people that think they are somehow above the "law" or entitled to some special treatment. As a fiduciary of the association I don't have a choice most of the time. Lastly, people need to stop thinking from the standpoint of "I" and remember they live in a common interest development, meaning "we."
